In our overwhelmingly digital world, the ability to capture and analyse ever-increasing volumes of data creates new opportunities, but also creates new risks. Privacy, intellectual property, security and related concerns need to be addressed by a clear data governance strategy. A key aspect of a successful data governance strategy is effective contracting.

In this session, Adrian and Liz will discuss data-related risks and issues, and provide a range of suggestions for how to address these issues in your contracts, including in relation to the following:

- interaction of confidentiality, IP and security regimes and their application to data;
- allocation of responsibility for legal obligations arising in relation to data;
- exclusions and limitations of liability for data loss; and
- provisions regulating handling of data at the end of the engagement.

Presenters

Adrian Lawrence
Adrian Lawrence is the head of the Firm's Asia Pacific Technology, Media & Telecommunications Group. He is a partner in the Sydney office of Baker McKenzie where he advises on media, intellectual property and information technology, providing advice in relation to major issues relating to the online and offline media interests. He is recognised as a leading Australian media and telecommunications lawyer.

Liz Grimwood-Taylor
Elizabeth is a Senior Associate within the Firm's Technology, Communications and Commercial practice group. Elizabeth advises on a range of commercial and non-contentious technology matters, including drafting and advising on payment processing, software licensing, services, distribution, hosting, advertising and marketing contracts (both business-to-business and consumer-facing). She has gained experience reviewing and advising on IT outsourcing contracts whilst on secondment to the Australian legal team of an IT enterprise services business. Elizabeth also advises on privacy, consumer protection and online retailing, including drafting end user licence agreements, privacy policies and spam laws.
