PANEL 2: Can Private Business Dictate Procedure to the Government? Legal Tools for Dealing with Government Procedures under the Due Process Clause and Takings Clause
Sometimes the difference between success and failure in a dispute with government depends whether procedures established by a branch of government must be followed by the government. The question of whether a government agency is required to follow its own internal procedures—even if the those procedures are not formally codified in an administrative code—arise in disputes involv-ing immigration, labor and employment, tax, environmental, licensing, and other types of cases. This panel will summarize the cur-rent state of the case law relating to the Accardi Doctrine and the Takings Clause and educate in-house counsel how to use these tools to protect the interest of the business.

PANEL 3: Responding to the Wolf at the Door
Unannounced visits by regulators – whether executing a search warrant or merely conducting a surprise inspection – present excep-tionally difficult challenges. Such visits present a host of issues. Under what circumstances are agents and inspectors permitted to conduct on-site employee interviews? Should employees be sent home? May outside counsel present him or herself as representing all employees, at least temporarily, without having first talked to the putative clients, and what are the consequences of that decision. Hear from in-house counsel, and law enforcement experts about how to respond in these situations, including what both in-house and outside counsel are permitted to do.
