How should you be handling personal data in Europe and the United States? European General Data Protection Regulation (GDPR) is now being enforced, and the California Consumer Privacy Act's (CCPA) enforcement is looming, what specific risks does your business face and how can you best address them?

Groundbreaking changes in privacy laws and regulations are occurring globally, including through the extensive reach of the European General Data Protection Regulation (GDPR) and the new California Consumer Privacy Act (CCPA). This two-part session will address lessons learned from the first several months since the GDPR became enforceable and insights into how the CCPA will affect businesses in California and beyond.

Session #1: Post-GDPR Roundtable During the first session, we will have roundtable discussions on how companies have addressed the privacy and data security compliance challenges of GDPR and identify key issues that in-house lawyers will need to consider going forward. This workshop session will divide members into separate tables wherein each table will discuss GDPR challenges that businesses are facing today. After discussion and sharing of lessons learned, each table will report highlights for the benefit of the whole group. Business challenge topics include: -Territorial scope/does GDPR apply? -Data Export Issues (privacy implications when data leaves the EU) -Data subject access rights -Preparing a data security breach response plan to comply with GDPR breach notification rules

Session #2: Compliance with California Consumer Privacy Act In this session, we will compare and contrast the GDPR and CCPA and discuss the objectives of efficiency and uniformity in business operations, weighed against competing objectives that may favor jurisdictionally-tailored compliance. We will review the CCPA exemptions for certain industries and discuss the opt-in and opt-out requirements of the CCPA versus those of the GDPR. The session will provide attendees with the tools to embark on a program for CCPA compliance that builds on work done to comply with the GDPR, while retaining flexibility as the forthcoming CCPA regulations evolve.

Happy Hour & Networking:
Following the conclusion of the second session there will be a happy hour reception, which will include drinks, light hors d'oeuvres and continued conversation in Arnold & Porter's Garden Room/Rooftop Terrace.
