ACC ArizonaContracts often contain provisions requiring one party to defend and/or indemnify the other in certain circumstances. The clauses often are backed up by insurance provisions. It is critically important to fully understand how these clauses do and do not work when drafting them and how litigation is likely to play out. There are nuanced distinctions between the applicability of insurance versus the indemnity and knowing how to deal with the insurance company and party providing the indemnity is often important to a successful outcome. This program explains the various issues and pitfalls to avoid when drafting and litigating indemnity clauses.
PRESENTERS:
Douglas C. Northup is an experienced trial attorney whose practice focuses on complex commercial, tort and professional liability litigation. In addition, he chairs the firm's business litigation practice group.
J. Chris Gooch specializes in business and real estate litigation.
