ACC San DiegoCalifornia, like many other states, has seen a recent adoption of legislation legalizing the recreational use of marijuana. While the legislation has been widely lauded by the voting public, its passage complicates the ever-changing world of permissive drug usage by members of the California workforce, and presents a host of new questions for California employers charged with maintaining legal compliance. This presentation will summarize the current state of the law and, just as importantly, discuss best practices for balancing the important (but occasionally countervailing) forces of legal compliance and employee desire.
Seasoned employment attorneys Thomas Ingrassia and Ryan Nell will lead a discussion focusing on: (1) Recent changes in both state and federal law as it relates to the use of marijuana, both for medical and recreational purposes; (2) How the legalization of recreational marijuana relates and differs from requirements that employers accommodate employees that use opioids; (3) Strategies for responding when employees appear to be impaired or otherwise under the influence; (4) Techniques for developing best practices for addressing employees that use drugs in violation of applicable policy and/or law; (5) Expectations for the coming years regarding this ever-changing area of the law.
