Session I: How Current is Your Employee/Volunteer Handbook?

An employee handbook can be incredibly valuable to a company if practical and implemented properly. This program will review the policies a company must include, might include, and should never include in its employee handbook. It will also review the policies that should be updated.

Session II: Who’s on First: Understanding Insurance Requirements in Contracts and the Interplay Between Different Insurance Policies
 
Often every party in a commercial transaction will require each of its counterparties to purchase insurance, whether it is general liability coverage, builder’s risk, an OCIP, wrap, cyber policy, or E&O.   When there is a loss, you may be surprised to learn that there is not as much insurance coverage for your exposure as you might have thought or hoped.  Understanding how insurance policies work together, who is responsible for the deductibles, and who can be the target of a subrogation action, is important to effective contract negotiation, risk transfer and assessment of potential exposure in the event of a loss.

Session III (ETHICS): Hot Topics in Attorney Client Privilege and Work Product

This presentation will cover hot topics relating to attorney client privilege and work product, with a focus on protection for board level communications, disclosures in governmental investigations, and communications with insurers.

Session IV: Best Practices for Defending Against and Preventing Antitrust Claims

This presentation will provide an update on recent antitrust litigation, including the Pepper v. Apple case and recent consumer protection case updates, and will provide Dos and Don’ts for defending against antitrust claims, including putative class claims.

Session V (ETHICS): Data Privacy & Cybersecurity Compliance: The Tipping Point

Legal executives are making “bet-the-job” decisions when it comes to data privacy and cybersecurity compliance.  Companies face tremendous financial exposure and liability under rapidly expanding US state privacy regulations from the California Consumer Privacy Act and several “copycat” bills that have already been introduced in other states.  Savvy plaintiffs' attorneys are exploiting private rights of action, statutory fines and new theories of liability to supercharge litigation against companies of all types and sizes.  This session will review emerging regulations, outline overlapping requirements,  discuss ethical obligations for attorneys with regards to safeguard client information,  and answer “bet-the-job” questions to help you meet your obligations, mitigate liabilities and protect your company.
