Business Crimes and Compliance Criminal Liability of Companies Survey : 2008
This Lex Mundi multi-jurisdictional survey represents a country-by-country overview of some key criminal offense laws. Each Lex Mundi member firm was asked to respond to a series of questions, regarding their jurisdiction. Some jurisdictions differentiate between regulatory (summary) offenses and criminal offenses. In many jurisdictions the rules of criminal procedure on the prosecution of criminal and regulatory offenses are similar. The term “offense” used in this paper means both types of offenses.

European Union: Accession States Tax Guide Survey: 2008
Lex Mundi has prepared and marketed internally a short, up dated practical guide, providing essential information on the tax systems in force of each new EU member state. The “EU Accession States Tax Guide” was initiated by Lex Mundi¹s International Tax Practice Group and was coordinated by Yerassimos C. Yannopoulos and Maria Vrachatis both members of Zepos & Yannopoulos (the Lex Mundi member firm in Greece). The aim of the relevant publication is to: (i) disseminate among Lex Mundi member firms key information on the tax systems covered and (ii) constitute a valuable tool for both members and clients in assessing the tax environment in each new member state in the pursuit of business activities and opportunities.

National Government Ethics Survey: An Inside View of Public Sector Ethics: 2008
The National Government Ethics Survey is a distinct and important part of the Ethics Resource Center's longitudinal survey work, the National Workplace Ethics Study. Since 1994, the Ethics Resource Center has fielded a nationally-representative poll of employees at all levels to understand how they view ethics and compliance at work. Previous reports presented aggregated findings from the business, government, and nonprofit sectors; 2007 marks the first time a separate government report has been issued. The findings of the National Workplace Ethics Study will be presented primarily through the National Business Ethics Survey, the National Nonprofit Ethics Survey, and the National Government Ethics Survey, as well as future webcasts, white papers, and research briefs.

Profile of In-house Counsel from Non-profit Organizations: 2007
299 In-house counsel from non-profit organizations responded. Respondents in this survey have worked as in-house counsel of non-profit companies an average of 12.3 years, and in other legal positions for an average of seven years before becoming in-house counsel. Most respondents also indicate that they have held one legal position with their current employer before assuming their present position, a role which counsel have had for an average of seven years.

2007 Compliance Program and Risk Assessment Benchmarking Survey: 2007
The Association of Corporate Counsel (ACC) and Corpedia, Inc., jointly administered the 2007 Compliance Program and Risk Assessment Benchmarking survey during February and March of 2007. Key topics were covered in the survey included: Compliance program leadership, staffing and spend; Ethics and compliance awareness and training; Challenges, privilege and the Board of Directors; Risk assessments; Hotlines, reports and organizational health surveys. Key findings include: 58 percent of all organizations have a Chief Compliance Officer while 28 percent have a Chief Ethics Officer; Almost one quarter (23 percent) of all organizations conduct risk assessments at least twice a year.

Lex Mundi Intellectual Property and Competition Law Survey: 2007
The intention was for the survey to concentrate on a number of particular aspects of competition/antitrust rules in respect of IP license agreements and supply/distribution agreements, to determine to what degree there might be uniformity (or not) of application across members¹ jurisdictions. In-House Counsel and the Attorney-Client Privilege: 2007
This Lex Mundi multi-jurisdictional survey presents a country-by-country overview of the availability of protection from disclosure of communications between in-house counsel and the officers, directors or employees of the companies they serve. Each Lex Mundi member firm was asked to describe briefly the applicability of the attorney-client privilege to communications with in-house counsel in its jurisdiction. The summaries presented below -- covering virtually all of the jurisdictions of the world -- address the following questions: Are communications between in-house counsel and officers, directors and employees of the company they serve privileged? If so, are there limitations on the privilege? If not privileged in and of themselves, are there alternative methods of protecting the information?

Pre-Merger Notification: 2007
A number of jurisdictions have implemented pre-merger notification procedures. The types of transactions addressed by these regulatory regimes, the type of information (if any) required to be submitted, the ability of regulators to delay a transaction, and the effect of pre-merger procedures, vary from jurisdiction to jurisdiction. Corporate Law Compensation & Management Survey (CLCM): 2007
Empsight's CLCM Survey has become the largest in-house law compensation survey in the U.S. focusing on large corporations / departments. Many ACC member companies participate in this survey. In 2006 the survey had 204 Participants with an average participant revenue size in excess of $19 Billion. The 2007 survey, which is about to be published, has similar participation. The survey reports data on base salary, annual bonus, long term incentives, and multiple sub-cuts (e.g. legal specialty, law department size, law school rank, revenue, and others). The survey also provides useful legal spending and staffing analyses.

Using Technology-Law Department Best Practices Survey: 2006
This article summarises the findings of the PLCLaw Department survey on using technology 2006. The survey was conducted by means of a confidential online questionnaire addressed to general counsel of leading multinational companies as listed in PLCLaw Department Profiles. The questionnaire was then followed up by a series of telephone interviews. The data was collected in March and April 2006. The Decline Of the Attorney-Client Privilege in the Corporate Context: 2006
The coalition of organizations involved in this survey believes that the attorney-client privilege and work product doctrine as applied in the corporate context are vital protections that serve society’s interests and protect clients’ Constitutional rights to counsel. The attorney-client privilege is fundamental to fairness and balance in our justice system and essential to corporate compliance regimes. Without reliable privilege protections, executives and other employees will be discouraged from asking difficult questions or seeking guidance regarding the most sensitive situations. Without meaningful privilege protections, lawyers are more likely to be excluded from operating in a preventive (rather than reactive) manner. In today’s complex business environment, it is increasingly important to encourage business executives and even line managers to regularly and without any hesitation – engage their lawyers in open discussions about anything that concerns them in furtherance of assuring the corporation’s legal health.
