Class Action Fairness Act

The Class Action Fairness Act is an important civil reform measure to expand
federal diversity jurisdiction over class action suits. Plaintiff's attorneys
often join nominal parties to their class action suits in order to defeat
diversity jurisdiction, thereby availing themselves of state court jurisdictions
they believe to have a more liberal procedural environment in which to pursue
their action. The Class Action Fairness Act would mandate that more big class
actions involving interstate issues be heard in federal court, overcoming
diversity jurisdiction roadblocks. Federal courts are historically more balanced
when weighing plaintiff and defendant rights in class actions, and are better
equipped to deal with these complex issues.
