Litigation vs. Arbitration: Which dispute resolution is better for your company or for your agreement?

Federal courts no longer review arbitration awards as they once did. The Supreme Court has interpreted the Federal Arbitration Act as allowing courts to review arbitration decisions only in cases in which there is some evidence that the arbitrator or arbitrators were biased or personally interested in the outcome. If arbitration is now almost as expensive and takes as long as litigation and has no safeguards to prevent an unjust or even illegal result, is arbitration ever appropriate? What choice is better for your situation? How can you protect your company? We'll update court decisions and look at the pros and cons litigation and arbitration.
