Negotiating Interstate Natural Gas Transportation And Storage Capacity Contracts -- How To Achieve Your Commercial Objectives In A Regulated World

Although many contracts for interstate natural gas transportation and storage capacity follow a pro forma agreement, some provisions can be negotiated in order to provide additional flexibility. Moreover, FERC recently has enacted new rules regarding contracting for capacity in the secondary market (i.e. the capacity release market) which provides parties with an ability to maximize their existing capacity contracts.

This webcast will identify the key provision in most contracts for interstate natural gas transportation and storage capacity and specifically will discuss the following types of arrangements:

  • Transportation and Storage Service Agreements for Existing Pipeline or Storage Capacity: we will highlight key terms commonly found in pro forma service agreements and pipeline tariffs, as well as review FERC policy on key contract provisions and parties' ability to deviate from pro forma agreements.
  • Precedent Agreements and Service Agreements for New Pipeline or Storage Capacity: we will discuss the process for obtaining future capacity and review provisions that parties may have the ability to negotiate in order to ensure that the contract meets their commercial objectives.
  • Prearranged Capacity Release Agreements: we will review the limitations and opportunities with regard to contracting for secondary capacity.
  • Asset Management Agreements: we will discuss opportunities to use AMA's to bundle transportation and storage capacity together with gas purchases and sales, and will review the specific regulatory requirements associated with this type of agreement.
