In 2009, U.S. Immigration and Customs Enforcement issued 562 I-9 audit notices to employers on the 4th of July weekend, and an additional 1,000 audit notices during the Thanksgiving weekend – each day’s total exceeding the total number of I-9 audit notices issued by ICE in all of FY2008. ICE’s recently issued national policy placing its investigation focus on criminally prosecuting employers rather than employees requires corporate counsel to aggressively manage I-9 and employee verification practices in order to avoid criminal investigation, grand jury subpoenas, civil sanctions, and federal contract debarment. Victor X. Cerda, partner at Jackson Lewis’ immigration practice and former ICE General Counsel will host a discussion with ICE Special Agent in Charge John Torres on what the new ICE strategy really means to your company, how ICE conducts its investigations of employers, and what best practices employers can implement to avoid the pitfalls leading to criminal and civil sanctions.
