For companies that do business internationally, understanding and complying with the U.S. Foreign Corrupt Practices Act (FCPA) has never been more important. FCPA enforcement has increased dramatically; since December 2008, the U.S. government has assessed more than USD $1.3 billion in financial consequences against U.S. and foreign companies under the once little-enforced  FCPA. Additionally, many executives have pleaded guilty to felony FCPA charges. The FCPA includes record-keeping requirements and  limits business development activities that can be lawfully engaged in when dealing with non-U.S. government and political party officials, including employees of state-owned enterprises. This webinar will: (i) provide  an  overview of the ambiguous requirements of the FCPA; (ii) update you on recent FCPA enforcement activity and trends;  (iii) identify corruption and fraud risk factors and red flags; (iv )  recommend  specific compliance practices that can help you reduce the liability exposure faced by your company and its employees under this far-reaching criminal statute; and (v) present best practices to enable corporations and their law firm advisors to work together to develop effective compliance programs to avoid, detect and remedy wrongdoing, especially fraud and corruption.
