Participation in the TARP and stimulus programs may have the potential to bring with it risks and liabilities.  These risks include not only claims based on the regulations implementing TARP but also under the False Claims Act (FCA). Although the FCA is best known for its extensive applicability in the government procurement and health care arenas, the Department of Justice has indicated that a number of whistleblower actions have been filed and are currently under investigation.  These lawsuits remain under seal in the courts so defendants may not even suspect that they have been named.
