Old Torts with a New Twist in the Age of Social Media

Defamation and Business Disparagement – Old Torts with a New Twist in the Age of Social Media

Presented and Sponsored by ACC's Litigation Committee and ACC's Dallas-Fort Worth Chapter
Social media allows the sharing of more information by more people, more quickly, and many times, less accurately.  Whether it is Yelp, a viral social media post, or an anonymous blog, your company may find itself negatively impacted. This presentation will discuss how defamation and business disparagement laws have been impacted by and applied to online platforms. The panel will also discuss the options available to companies that receive such negative comments, including takedowns, discovery of anonymous users, notices under the Uniform Correction or Clarification of Defamation Act, the impact of the Consumer Review Fairness Act, and potential causes of action.
