What You Should Know About New Federal Waste Energy Programs

Written by Energy Committee Vice Chair Tracey Steiner and Bill DeGrandis of Paul Hastings Janofsky & Walker.

With rising energy costs and concerns about reducing both energy consumption and greenhouse gas emissions, Congress sought to promote cogeneration -- the capturing of the byproduct heat or "waste energy" generated by industrial or manufacturing processes to generate electricity -- in the Energy Independence and Security Act of 2007 (EISA). This article provides legal and practical information to help your company decide whether to pursue the financial and other incentives available under EISA's industrial waste energy programs. It also highlights certain legal and regulatory implications to be considered before pursuing a waste energy project and how to reduce or mitigate federal and/or state regulation.
