WMACCA AND ACC COMMENT ON New VIRGINIA
RULE ON ADMISSION WITHOUT EXAMINATION
The Supreme Court of Virginia recently adopted new rules on admission without examination that will significantly expand the opportunities for attorneys to use membership in another jurisdiction's bar to gain admission to the Virginia State Bar. However, the Court made one significant change in the final rule from the drafts we had commented on: Now, the applicant for admission without examination must have taken the Bar examination in the applicant's "reciprocal jurisdiction." We believe that this change may create a barrier for many of our members who would like to move from holding a Corporate Counsel Certificate in Virginia to full membership in the Virginia State Bar.
On March 4, WMACCA and ACC submitted a letter to the Virginia Supreme Court asking that body to carve-out a narrow exception to the "by examination" requirement of the new rule that would apply to in-house counsel practicing with a Corporate Counsel Certificate under Rule 1A:5, Part I. Our position has been endorsed by 10 CLOs of prominent Virginia comopanies. To read the letter, please click here.
