MO Supreme court Establishes amnesty for in-house counsel
The Missouri Supreme Court has established an amnesty program for Missouri in-house counsels, who are not properly licensed to practice law in the State of Missouri.Under Rule 4-5.5 of the Missouri Rules of Professional Conduct, an in-house counsel who has established "an office or other systematic and continuous presence" in Missouri must be licensed to practice law in the state of Missouri, either by obtaining a limited license pursuant to Rule 8.105 or a general license pursuant to the other provisions of Rule 8.
Some in-house counsel, relocating to Missouri from other jurisdictions where they have been properly admitted, may not be aware of these requirements and have found themselves in violation of the Missouri rules. This not only exposes those lawyers to the potential of sanctions for an ethical violation but also exposes the other lawyers in their legal departments to sanctions for assisting in the unauthorized practice of law.For the Full Article CLICK HERE
