Overview

California companies that manufacture, market, sell or resell products to businesses and consumers in California incur significant and unsettling litigation risks. The potential of costly litigation and regulatory action includes the follow four principal categories: 
Risks relating to product liability claims if a person or property is injured or damaged;
Risks of breach of warranty claims in both the consumer and B2B context; 
Risks of false advertising and consumer protection claims, including class actions and regulatory investigation; and 
Risks arising from the collection, use or compromise of consumer data and personal information.

In this presentation, Kent Schmidt, a California commercial litigation attorney, will explore how businesses exposed to these other product-related risks can take prophylactic measures to reduce the potential of costly litigation and regulatory action. The presentation will include a discussion about how to create an effective litigation risk profile, negotiate robust contracting terms, keep abreast of trends in consumer class actions and related topics.
