You probably know something about the ACC Value Challenge and its focus on reconnecting the cost of legal services to their value. For many of you and your firms, this will mean looking at new ways to staff work that you outsource to firms and others, as well as new ways to control the cost of work, including value-based, contingency/incentive, or alternative fee arrangements that go beyond “discounts” off the hourly fee and fundamentally re-structure the law firm business model. But the Model Rules of Professional Conduct and our ethical obligations have a lot to say (even if it’s not always helpful!) about whether lawyers and clients can engage in fee agreements that re-allocate risk, or that create incentives or rewards to firms for certain outcomes, or that mandate staffing and processes in the firm’s work that places efficiencies on par with what has traditionally been reserved as the domain of outside counsel’s judgment. What does it mean to mainline professionals when clients start talking about alignment, sharing risk, and increased “skin in the game”? How can you adopt more alternative based fees and progressive staffing structures “the professional way,” and what are the ethical pitfalls or problems to avoid? This program will begin to explore these issues through a mixture of presentation and interactive dialogue with the audience.
