Litigation Forum: Crisis Management - Keeping Your Head When Everyone Around You Is Losing Theirs

The General Counsel plays a critical role in successfully managing a corporate crisis.  The preparation of a comprehensive and thoughtful strategy that keeps focus on managing the crisis and the likely legal exposures in the context of the company’s long-term business objectives is essential.  This program will address the legal and practical issues for counsel to consider in preparing for a crisis, including how to identify the risks and the players, develop the strategy framework, implement the crisis management plan, and recover from the crisis. The discussion will include best practices for protecting the attorney-client privilege, responding to criminal and congressional inquiries, handling crises with international dimensions and establishing corporate social responsibility programs. The panel, which includes attorneys with substantial experience in crisis management, will discuss formulating a multi-prong response that allows the company to resolve the immediate crisis, and to communicate with customers, government officials and the media with government oversight and potential litigation in mind.
