When do we discuss settlement?  Should we mediate?  Or arbitrate?  How do we evaluate a case for settlement?  Because 95% of all cases settle before trial, settlement analysis and strategy are a critical phase of any dispute.  Experienced trial lawyers will focus on settlement analysis and case evaluation from both a procedural and economic perspective to enable in-house counsel to advise management on claims headed for trial. 
 
Topics covered include:  Mediation strategy; Effective use of arbitration; Conducting a risk analysis -- how to assess with your executives the costs and benefits of settlement v. trial; Interaction with outside counsel.
