Commercial agreements often contain indemnity provisions that seek to sort out the rights and responsibilities of the parties in the event of a casualty loss. But is the language used enforceable, and what remedies are available if a party fails to meet its indemnity obligations under the contract? And if an additional insured provision is included in the agreement, what steps can the parties take to maximize effective enforceability of the provision?
