Session I, 8:00 a.m. to 9:00 a.m. - Emerging Issues for Litigators Working with Accountants

A number of recent developments will have significant implications for the role of accounting professionals in litigation.  The panel will provide unique insight from accounting and financial professionals concerning three issues: how recent changes to the federal tax laws will affect valuation issues in litigation; disputes that result from accounting changes; and controversies that will arise from the emergence of “cryptocurrency” such as Bitcoin.

Session II, 9:10 a.m. to 10:10 a.m. - Non-Compete Agreements: A Sword and a Shield

This panel will discuss practical considerations for the drafting, enforcement and challenging of non-competition agreements in a global economy.

Session III, 10:20 a.m. to 11:20 a.m. - Alternative Fee Arrangements: Considerations for In-House and Outside Counsel

Faced with shrinking budgets and growing workloads, many corporate law departments are demanding flexibility from their outside counsel as the costs for litigation and corporate work continue to increase.  This presentation discusses one approach to managing outside legal costs:  moving away from a traditional rate times hours billing model and towards alternative fee arrangements.  Among other things, we will discuss:

  • The types of issues that should be discussed before deciding what billing approach is appropriate for a particular matter;
  • The benefits of this arrangement to in-house counsel, including certainty flexibility, and budgetary control;
  • The different types of alternative fee arrangements and how they are applied across different practice areas; and
  • The importance of collaborative discussions between outside and in-house counsel to achieve a “win-win” relationship.
