Overview

In 1932, a Presidential election was lost with the incumbent’s ill advised campaign slogan, “Prosperity is just around the corner.”  But prosperity does eventually return, though seldom when it is expected.  Accordingly, companies and their legal counsel have to consider the effect that actions taken during economic crisis will have on competitiveness when conditions improve.  A panel of DGS attorneys will make brief presentations on various legal challenges that companies may be facing in this area, such as: 

  • Retaining key employees with shareholder-aligned incentives
  • Expanding facilities & production after cutbacks
  • Re-hiring practices after layoffs
  • Preparing for (or heading off) litigation from the downturn
  • Drafting contracts with flexible or adjustable terms

As always, presentations will be followed by an open discussion of specific issues raised by attendees.
