Overview
Today’s current M&A landscape is fraught with both uncertainty and opportunities; distressed M&A transactions have their own challenges and risks, which need to be understood and managed if deals are to be successfully executed. Cross-border M&A activity is increasingly seen as a key strategy for growth into larger markets but the deals are not without real risk.
Recent amendments to Canadian bankruptcy, insolvency and restructuring legislation will change the tactics employed by corporate counsel in dealing with troubled customers and suppliers and in addressing their own corporate fiscal challenges.
