Advocacy

Dear ACC Leaders in Texas:

I know you're busy -- but 5 minutes of your time can make the difference between whether your client's attorney-client privilege is protected in the corporate context or whether its erosion will continue at the hands of government prosecutors and regulators.

The Attorney-Client Privilege Protection Act (click here for H.R. 3013 / S. 186 - copy of the legislation) is very close to moving toward mark-up and passage after two years of hard work. Senator Cornyn, who sits on the Judiciary Committee, is weighing whether he will sign on to co-sponsor the bill and urge its swift movement toward a vote. We have several major co-sponsors on the Senate Judiciary Committee from both sides of the aisle, but for a variety of reasons, Senator Cornyn's decision to step up and demand that the bill move could be the difference between success and the round file when it comes to convincing Senator Leahy to move the bill.

I urge you to call the Senator's office (or ask your government affairs office to call) and urge him to 1.) co-sponsor S.186 and 2.)send a personal message to Senator Leahy that the bill must move to mark-up.

I've attached a full set of talking points on the bill (click for attachment) in case you need them.

The House passed its version of this bill with broad bi-partisan support. There is broad bi-partisan support in the Senate. It is time to move this bill forward and you'd appreciate the Senator's support.

Please ask whomever you speak to (assuming it's not the Senator himself!) to indicate to you if the Senator plans tosupport/co-sponsor this bill, and if he doesn't know yet, tocommunicate to you what his decision is when he's made it.

I would greatly appreciate a quick reply email with any action you take ("called and left a voice mail message" - or "sent an email" or "spoke with XXXX") as well as any feedback you might get if you talk to someone live.

Thanks so much for your help at this critical juncture. ACC is taking it to the wall to bring this one home for members and their clients, but we need to show that real constituents care in order to bring theissue home to the Senators who will decide whether the bill moves ordies. Hopefully, we'll have good news to report in the coming days.

Please feel free to call me if you have any questions or concerns I may address.
