Professional Privilege in Switzerland


Switzerland: New Statute on In-House Counsels:

Beginning of this year, the Swiss Federal Department of Justice has published the preliminary draft for a new statute on in-house counsel. Further information is available from below documents and on the homepage of the Department of Justice (see links at the end of this page).

The proposed new statute is very important for the in-house profession in Switzerland. It suggests introducing an attorney-client privilege and a supervisory body for in-house lawyers in Switzerland. The new legislation clearly strengthens the position of in-house counsel in Switzerland and is strongly supported by ACCE.

Beginning of June, the draft statute was discussed at a special session at the Annual Conference of ACC Europe in Geneva. Based on the feedback and comments received from its members during this session, ACC Europe submitted a position paper to the Federal Department of Justice end of July.
